Biotech2k Maps Insmed Incorporated (NASDAQ: INSM) TPIP Patent Path

What happened

Biotech2k puts the right question in front of investors in Insmed Incorporated (NASDAQ: INSM). Does distinct prodrug chemistry create a clean patent path around Tyvaso? Filings from Insmed Incorporated (NASDAQ: INSM) show a TPIP patent estate through 2034, but they do not prove freedom to operate against patents held by United Therapeutics Corporation (NASDAQ: UTHR).

The question became timely on October 15. Insmed Incorporated (NASDAQ: INSM) said three of four pivotal Phase 3 PALM studies are now active across pulmonary arterial hypertension, pulmonary hypertension associated with interstitial lung disease and progressive pulmonary fibrosis.

That is 75% of the planned pivotal program. The ratio measures development breadth, not approval probability.

Biotech2k argues that TPIP's prodrug linker differs from the chemistry in competing patents and that some earlier inhaled-treprostinil patents expire in 2027 and 2028. That is his analytical conclusion, not company guidance or a legal opinion.

Why it matters

The useful part of Biotech2k's work is the focus on claim boundaries. A Phase 3 result can establish clinical evidence. It does not answer whether a commercial product infringes a valid patent.

Insmed Incorporated (NASDAQ: INSM) reports six issued U.S. patents covering TPIP's compound, formulations and pulmonary uses that expire in October 2034. Pending applications could extend protection into 2041.

The countercase is economically material. United Therapeutics Corporation (NASDAQ: UTHR) generated $1.878 billion from Tyvaso DPI and nebulized Tyvaso in 2025, or 59% of total revenue. Its filing lists Tyvaso DPI patents with expirations running from 2027 through 2042 and identifies TPIP as a competitor.

Those dates show overlapping commercial stakes, not the winner. Patent applicability turns on claim language, validity and the final TPIP product. Public filings do not settle those questions.

What's next

The next operating test is enrollment across the PALM program and the planned start of PALM-IPF in the first half of 2027. Insmed Incorporated (NASDAQ: INSM) says the four studies should enroll more than 2,000 patients globally.

The next patent test is a concrete disclosure: a licensing agreement, a claim-level company analysis, litigation or a regulatory filing that fixes the commercial formulation and labeling.

Biotech2k's estimate of more than $5 billion in possible PH-ILD revenue remains his estimate. The filings support the importance of the question, but not that revenue outcome or a risk-free path to it.
